Photography

Lessig's book Free Culture mentions how early in the history of photography, “courts were asked whether the photographer, amateur or professional, required permission before he could capture and print whatever image he wanted.” The argument in favor of this was that the person taking the photograph was “taking” something of value from whatever he was shooting. “Some even thought he was taking the target’s soul.” The argument against this was that “citizens should have the right to capture at least those images that stand in public view.” Luckily, they ruled against this. How do you guys feel about the freedom to photograph anything, anywhere, anytime with no restrictions? Do you believe there are any cases in which restrictions should be implemented?
